The growth of the global Internet has created an
interconnected world where security is only as strong
as its weakest link. A recent Computer Security
Institute/FBI survey found that 90 percent of
practitioners polled had suffered security breaches
within the previous 12 months, with 80 percent
acknowledging financial loss due to the attacks.
The Organization for Economic Cooperation and
Development (OECD), which encompasses the 30 most
advanced industrialized nations, recently updated its
Guidelines for the Security of Information Systems and
Networks to reflect the more interconnected nature of
computer networks. This "call to action" is the next
step in fostering an online "culture of security"
among companies both large and small. Commissioner
Swindle is head of the United States Delegation to the
OECD Experts Group for Review of the 1992 OECD
Guidelines for the Security of Information Systems and
Networks.

JUSTICE APPROPRIATIONS AUTHORIZATION ACT (H.R. 2215)
On Saturday, November 2, President Bush signed into
law the 21st Century Department of Justice
Appropriations
Authorization Act (H.R. 2215), which includes the
Technology, Education, and Copyright Harmonization
(TEACH) Act as well as technical amendments to the
Copyright Act. The TEACH Act amends the Copyright Act
to provide increased flexibility for accredited
nonprofit educational institutions, as part of
"mediated instructional activities," to use the
Internet to provide copyrighted materials to students
enrolled in distance education programs.

487, and the Copyright Technical Corrections Act,
previously introduced as H.R. 614, may be found

ABSTRACT
The current draft National Strategy to Secure
Cyberspace was developed in close collaboration with
key sectors of the economy that rely on cyberspace:
state, and local governments, colleges and
universities, and concerned organizations. Sector
groups developed their own strategies to protect the
parts of cyberspace on which they rely. Town hall
meetings were held around the country, and fifty-three
clusters of key questions were published to spark
public debate. This unique partnership and process is
necessary because the majority of the country's cyber
resources are controlled by entities outside of
government. For the Strategy to work, it must be a
plan to which a broad cross-section of the country is
committed, and must be dynamic and continually
refreshed to adapt to the changing environment as
technologies evolve. This presentation will discuss
how America will continue to utilize and rely upon
cyberspace and how the Federal government will seek a
continuing broad partnership to develop, implement and
refine the National Strategy.
BIOGRAPHICAL SKETCH OF SPEAKER
Howard A. Schmidt is a Special assistant to the
President and the Vice Chair of the President's
Critical Infrastructure Protection Board. This board
assists a specialized group of senior government and
private sector leaders in focusing on cyber security
issues and coordination of security-related incidents.
Previously, he was chief security officer for
Microsoft, director of the Air Force Office of Special
Investigations (AFOSI) Computer Forensic Lab and
Computer Crime and Information Warfare Division, with
the Computer Exploitation Team at the FBI's National
Drug Intelligence Center, and a city police officer in
Chandler, Arizona.Mr. Schmidt has also served as the
international president of the Information Systems
Security Association (ISSA) and holds a bachelor's
degree in business administration and a master's
degree in organizational management.

On October 18, 2002, AT&T Corp. (AT&T) filed a
Petition for Declaratory Ruling that AT&T's
Phone-to-Phone IP Telephony Services are Exempt from
Access Charges. AT&T states that, currently, it
provides phone-to-phone enhanced voice prepaid card
services as well as basic phone-to-phone Internet
protocol (IP) telephony services. AT&T explains
that, in contrast to calls transmitted over private
interexchange networks that use Internet protocol,
AT&T's services are transmitted over the same "common"
Internet backbone facilities that carry Internet
service provider (ISP) and all other types of public
Internet traffic.
According to AT&T, incumbent local exchange carriers
(ILECs) are attempting to impose access charges on
AT&T's phone-to-phone IP telephony services by: (1)
refusing to provision end user services to terminate
AT&T's phone-to-phone IP telephony services; (2)
refusing to complete phone-to-phone IP telephony calls
over facilities that have been provisioned; and (3)
assessing interstate access charges on phone-to-phone
IP telephony calls from other states that are
terminated through CLEC and ILEC reciprocal
compensation trunks. AT&T asserts that these efforts
to impose access charges on AT&T's phone-to-phone IP
telephony services violate the congressional mandate
to preserve a competitive free market for the Internet
and the Commission's policy of exempting all VoIP
services from access charges pending the future
adoption of regulations on this subject.
AT&T asks that the Commission issue a declaratory
ruling that providers of VoIP services carried over
the Internet are entitled to subscribe to local
services and are exempt from interstate access charges
unless and until the Commission adopts regulations
that prospectively provide otherwise.
We seek comment on AT&T's petition for declaratory
ruling.
Pursuant to sections 1.415 and 1.419 of the
Commission's rules, interested parties may file
comments no later than December 18, 2002. Interested
parties may file reply comments no later than January
7, 2003. All responsive filings must reference the
docket number of this proceeding, WC Docket No.
02-361. Comments and reply comments may be filed
using the Commission's Electronic Comment Filing
System (ECFS) or by filing paper copies.

2002. The Copyright Office is also requesting Notices

Below is a brief summary describing this publication:
(For Procurement Officials, Implementers, Vendors and
Others Interested in Specifying
S/MIME Technology) S/MIME (Secure / Multipurpose
Internet Mail Extensions) is a set of specifications
for securing electronic mail. S/MIME is based upon the
widely used MIME standard [MIME] and describes a
protocol for adding cryptographic security services
through MIME encapsulation of digitally signed and
encrypted objects. The basic security services offered
by S/MIME are authentication, non-repudiation of
origin, message integrity, and message privacy.
Optional security services include signed receipts,
security labels, secure mailing lists, and an extended
method of identifying the signer's certificate(s).
S/MIME adds features to e-mail messaging including
privacy (using encryption), authentication of sending
party (using digital signatures), integrity
(non-alteration of messages), etc. S/MIME V3 is the
latest version of S/MIME and is supported in whole or
part by several vendors with
"Commercial-Off-The-Shelf" (COTS) products.
Because S/MIME still uses the same extant Internet
e-mail technology that has been widely deployed for
many years, it is not necessary to modify or replace
e-mail "servers" to accommodate S/MIME. Rather S/MIME
functionality may be added to e-mail "client"
software. By not disturbing the underlying e-mail
server/message transfer system, S/MIME allows gradual
migration from non-secure to secure e-mail messaging,
rather than requiring a large, possibly abrupt change
in technology.

NETWORK RELIABILITY AND INTEROPERABILITY COUNCIL TO
HOLD MEETING
A meeting of the Network Reliability and
Interoperability Council ("Council") will be held
Friday, December 6, 2002, at 10:00 a.m. at the Federal
Communications Commission, Room TW-C305, 445 12th
Street, S.W., Washington, D.C. 20554.
The Council was established by the Federal
Communications Commission to bring together leaders of
the telecommunications industry and telecommunications
experts from academic, consumer and other
organizations to explore and recommend measures that
will enhance network reliability and security.
At the December 6 meeting, the council will consider
proposals from the Physical Security, the Cyber
Security and the Reliability Focus Groups. The
Physical Security and Cyber Security Focus Groups will
present recommended best practices to better fortify
the physical and cyber assets of the
telecommunications infrastructure against terrorist
activities or natural disasters. The Reliability
Focus Group will present recommended requirements for
network reliability measurements for wireline,
wireless, internet and cable public communications
networks.
Members of the general public may attend the meeting.
The Federal Communications Commission will attempt to
accommodate as many people as possible. Admittance,
however, will be limited to the seating available. The
public may submit written comments before the meeting
to Jeffery Goldthorp, the Commission's Designated
Federal Officer for the Network Reliability and
Interoperability Council.

COMMISSION SEEKS PUBLIC COMMENT ON SPECTRUM POLICY
TASK FORCE REPORT

On November 15, 2002, the Commission's Spectrum Policy
Task Force released its Report to the Commission
containing its findings and recommendations. The
Commission hereby seeks comment on the Spectrum Policy
Task Force Report. We request that interested parties
submit written comments on the specific findings and
recommendations in the Report and we welcome comments
from all interested parties, including, but not
limited to, academia, private industry, consumers, and
all levels of government. The Spectrum Policy Task
Force Report was drafted by FCC staff and was not
voted on or approved by the Commission. Accordingly,
neither the Report nor any of the recommendations
contained therein necessarily reflect the views of the
Commission.
The text of the Report and other Task Force documents
may be downloaded from the Task Force's web site at
http://www.fcc.gov/sptf/ or may be obtained from the
Commission's copy contractor, Qualex (see contact
information below).
Interested parties may file comments no later than
January 9, 2003. Reply comments are due February 10,
2003. All filings should refer to ET Docket No.
02-135.
Parties who choose to file by paper must file an
original and four copies of each filing. If more than
one docket or rulemaking number appears in the caption
of this proceeding, commenters must submit two
additional copies for each additional docket or
rulemaking number. Filings can be sent by hand or
messenger delivery, by commercial overnight courier,
or by first-class or overnight U.S. Postal Service
mail (although we continue to experience delays in
receiving U.S. Postal Service mail). The Commission's
contractor, Vistronix, Inc., will receive
hand-delivered or messenger-delivered paper filings
for the Commission's Secretary at 236 Massachusetts
Avenue, N.E., Suite 110, Washington, D.C. 20002. The
filing hours at this location are 8:00 a.m. to 7:00
p.m. All hand deliveries must be held together with
rubber bands or fasteners. Any envelopes must be
disposed of before entering the building. Commercial
overnight mail (other than U.S. Postal Service Express
Mail and Priority Mail) must be sent to 9300 East
Hampton Drive, Capitol Heights, MD 20743. U.S. Postal
Service first-class mail, Express Mail, and Priority
Mail should be addressed to 445 12th Street, S.W.,
Washington, D.C. 20554. All filings must be addressed
to the Commission's Secretary, Office of the
Secretary, Federal Communications Commission. A copy
should also be sent to Peter Tenhula, 445 12th Street,
S.W., Room 2-C343, Washington, D.C. 20554.
The Task Force Report and copies of the comments and
reply comments filed in this matter may be obtained
from Qualex, 445 12th Street, S.W., Room CY-B402,
Washington, D.C. 20554, telephone (202) 863-2893. The
documents are also available for public inspection and
copying during normal reference room hours at the FCC
Reference Information Center, 445 12th Street, S.W.,
Room CY-A257, Washington, D.C. 20554.
Instead of filing paper comments, parties are
encouraged to file comments using the Commission's
Electronic Comment Filing System (ECFS). See
Electronic Filing of Documents in Rulemaking
Proceedings, 63 Fed. Reg. 24,121 (1998). Comments
filed through the ECFS can be sent as an electronic
file via the Internet to
http://www.fcc.gov/e-file/ecfs.html. Only one copy of
an electronic submission must be filed. In completing
the transmittal screen, commenters should include
their full name, Postal Service mailing address, and
the applicable docket or rulemaking number. Parties
may also submit an electronic comment by Internet

comments, commenters should send an e-mail to
ecfs@fcc.gov, and should include the following words
in the body of the message, "get form ." A sample form and directions will be sent
in reply. Commenters also may obtain a copy of the
