U.S.C. § 160(c).  In its petition, Qwest asks the

EFF Wins Preliminary Victory Over AT&T - Case Will Not
Be Dismissed, Broadband Reports, 7/21/2006 
The Electronic Frontier Foundation reports that a
federal Judge has denied AT&T and U.S. Government
efforts to dismiss the EFF's class action lawsuit
against AT&T. The EFF has filed a class action lawsuit
alleging AT&T divulged customer records wholesale to
the NSA without a court order. Both AT&T and Uncle Sam
had hoped to have the lawsuit dismissed under the
premise of national security protection. "The
compromise between liberty and security remains a
difficult one,'' Judge Walker wrote in his ruling,

case at the outset would sacrifice liberty for no
apparent enhancement of security.''
