The issue presented in this case is whether the court
of appeal properly enjoined the issuance of $125
million in municipal bonds to fund the construction
and implementation of a “Fiber-to-the-Home” (“FTTH”)
telecommunications system in the City of Lafayette.
The court of appeal found that the ordinance
authorizing issuance of the bonds violates the Local
Government Fair Competition Act, La. Rev. Stat.
45:844.41-45:844.56. Following our review of the law
and the record in this case, we find that the court of
appeal improperly enjoined the issuance of the bonds.
Thus, we reverse the court of appeal judgment and deny
plaintiffs’ request that issuance of the bonds be
enjoined.
