OECD Broadband Portal, PFF, 11/13/2007
The OECD now provides a host of broadband data in
addition to penetration in its "Broadband Portal." I
have criticized the OECD numbers in the past and am
pleased to see them showing a more complete picture of
the available data and better explaining the source of
the numbers.

When Broadband Duopolists Fight, We Win? Maybe . . .
., PK, 11/13/2007
Throughout 2006, while cable cos and telcos bitterly
fought each other for regulatory advantage, they
remained united on one thing: DEATH TO NETWORK
NEUTRALITY. So Iâm a little surprised that this
letter from telco sock puppet Hands Off The Internet
(HOTI) saying that the FCC has authority to act on our
complaint and declaratory ruling against Comcast and
urging the FCC to do so expeditiously got so little
attention. Frankly, this should draw the same kind of
attention as Rudy Guliani saying he would root for the
Red Sox in the World Series.

Cable Firms Seethe as FCC Chair Proposes Clampdown,
Ecommerce Times, 11/13/2007
Cable TV companies are swarming like angry bees over
the Federal Communications Commission's desire to
tighten its regulatory grip to spark competition and
programming diversity. According to published reports,
FCC Chairman Kevin Martin will try to enforce a 1984
rule that would force the cable companies to change
some practices. Martin is considering invoking the
"70/70" rule, a measure that grants wide-ranging
regulatory power to the FCC.

Funny How Anti-Regulation Telco Buddy Kevin Martin Is
Pro-Regulation When It Comes To Cable, Techdirt,
11/13/2007
December's almost here, and with it, comes FCC chair
Kevin Martin's birthday (December 14th, for those who
care). This might not seem like a big deal to many,
but it was just a couple years ago that a bunch of
telco execs got together to sing Martin happy birthday
just as he announced a bunch of policy positions that
seemed to support the telcos' every wish. What's most
amazing is that whenever he's pushed on telco issues,
Martin likes to claim that he's against regulations --
but when it comes to companies that the telcos compete
with, he's suddenly much more open to regulations.

Third Circuit affirms Dimeo v. Max â Section 230
immunity applies to forum board operator, Internet
Cases, 11/13/2007
Last year plaintiff DiMeo sued Tucker Max for
defamation over some postings to the message board on
Maxâs site. Max successfully moved to dismiss the
case, arguing that the Communications Decency Act at
47 U.S.C. §230 provided immunity against the
defamation claim. [Read about the lower courtâs
decision.] DiMeo appealed the dismissal to the Third
Circuit, but the appellate court affirmed.

âImmunityâ not accurate description for 47 USC 230
protection, Internet Cases, 11/13/2007
Ripoffreport.com is a website where individuals can
post information about companies, ostensibly to warn
other consumers of unscrupulous practices or bad
service. Children of America, Inc. sued
Ripoffreport.com in Arizona state court for
defamation. Ripoffreport.com moved to dismiss,

Communications Decency Act at 47 U.S.C. 230, which
state that â[n]o provider or user of an interactive
computer service shall be treated as the publisher or
speaker of any information provided by another
information content provider.â The court granted the
motion in part and denied it in part

Verizon Violates Net Neutrality with DNS Deviations,
Freedom to Tinker, 11/13/2007
While many of us were discussing Comcastâs partial
blocking of BitTorrent Traffic, and debating its
implications for the net neutrality debate, a more
clear-cut neutrality violation was apparently taking
place on Verizonâs network â a redirection of
Verizon customersâ failed DNS lookups, to drive
traffic to Verizonâs own search engine.

faster FiOS speed. Nothing particularly new here that
we haven't covered previously (bendable fiber,
symmetrical 20Mbps, faster tiers, GPON) though they do
note that they're seeing peak speeds of 400Mbps during
ongoing trials in Pennsylvania:
