"I heard about this thing called the Internet. I
thought, That sounds kind of interesting. The first
thing I did is I actually picked up the phone and
dialed 411, and I said, I’d like the number for the
Internet, please. And the operator is like, What? I
said, Just search any company with the word Internet
in the name. Blank. Nothing. I thought, Wow, this is
interesting. What is this thing anyway?" Sky Dalton,
quoted in Vanity Fair July 2008

Guest commentary: FTTH or wireless, which is more
cost-effective?, Muni
Recently, I spoke to the communities of Western
Tennessee at their Summit on Economic Development and
Broadband. Not unlike other communities, the need for
economic growth in the new age is paramount in their
plans. I explained our ideas on how to capitalize on
the broadband super highway. Attending the event were
many communities who find that they are wrestling with
the activity of sorting through their technical
choices. One such question came after the event and I
felt that sharing our technical answers to this query
would benefit other communities who may also have the
same questions.

AT&T Considers Usage-Based Pricing as BitTorrent
Solution - AT&T wants to keep P2P customers but wants
them to pay for what they use, dslreports
AT&T is considering a move to usage-based pricing
which would allow the company to continue to let
BitTorrents thrive on the site but at a price to the
people who are taking up all of the network s
capacity. The company says that it views BitTorrent
users as a positive thing and wants to keep those
customers but that it hasn t been financially
beneficial to build out a network that will support
the small number of customers that are using the bulk
of the network.

Consumer Groups Want Charter, NebuAD Investigated - 15
groups show support for bi-partisan probe into
behavioral ads, dslreports
Last month, the ranking members of the House
Telecommunications Subcommittee, Edward Markey (D-MA)
and Joe Barton (R-TX), sent a letter to Charter CEO
Neil Smit. That letter took issue with Charter's
decision to sell user browsing history to NebuAD in
order to deliver tailored ads (a "service" Charter
claims is as good as delivering faster speeds). The
letter asked Charter to put a hold on the project
since it's not clear it's even legal.

Why Mark Cuban's only half right about tiered
broadband, CNET
There's no argument that the Internet is getting
clogged up by massive dumps of video--and that's only
going to get worse. But there are better ideas than a
pay-as-you go approach.

Comcast Circulates Unredacted User Check Online -
After woman mails check for 'my right arm and zero
dollars', dslreports
This AP story is one of the stranger tales I've seen
this week. Apparently a woman sent Comcast a check
made out for "My Right Arm and Zero Dollars," as a
joke protest against high prices (she'd already paid
online), and then got more than she bargained for.
She's now suing Comcast after someone at the cable
company photocopied her check and circulated it around
the Internet. A quick Google search finds the woman's
full story in the comment section of the Comcast Must
Die website:

Study Shows DMCA Takedowns Based on Inconclusive
Evidence, Freedom to Tinker
A new study by Michael Piatek, Yoshi Kohno and Arvind
Krishnamurthy at the University of Washington shows
that copyright owners’ representatives sometimes send
DMCA takedown notices where there is no infringement —
and even to printers and other devices that don’t
download any music or movies. The authors of the study
received more than 400 spurious takedown notices.

Ballmer: Only IP-delivered media to survive, Lost
Remote
Microsoft CEO Steve Ballmer spoke with Washington Post
editors and reporters about the future of media. “In
the next 10 years, the whole world of media,
communications and advertising are going to be turned
upside down — my opinion,” he said. “Number one, there
will be no media consumption left in 10 years that is
not delivered over an IP network. There will be no
newspapers, no magazines that are delivered in paper
form. Everything gets delivered in an electronic
form.” He continues, “If we want TV to be more
interactive, you’ll deliver it over an IP network. I
mean, it’s sort of funny today. My son will stay up
all night basically playing Xbox Live with friends
that are in various parts of the world, and yet I
can’t sit there in front of the TV and have the same
kind of a social interaction around my favorite
basketball game or golf match. It’s just because one
of these things is delivered over an IP network and
the other is not.” Ballmer also said the number of
content providers will continue to grow. (Thanks Jake
for the link! Full disclosure: Microsoft owns half of
msnbc.com, which is my employer.)

Swire on Cybercrime Underenforcement, Tech Liberation

Peter Swire of the Center for American Progress has a
paper out called “No Cop on the Beat: Underenforcement
in E-Commerce and Cybercrime.” He identifies how local
law enforcement lacks the ability and incentive to
address various wrongs done on the Internet because of
their complexity and their multi-jurisdictional
nature.

McCain Revises Stance on Warrantless Wiretapping

Mere hours after a McCain spokesperson adopted the
Bush Administration's flawed legal argument that
courts have "recognized the President’s constitutional
authority to conduct warrant-less surveillance" and
that the "courts’ findings supported the Bush
Administration’s efforts in the wake of September 11,
2001," Senator John McCain said that:
