Kentucky settles banned blogger’s First Amendment challenge to Internet filtering policy, Internet Cases
Political blogger Mark Nickolas yesterday settled his lawsuit against Kentucky, in which he challenged the state’s policy of blocking blogs on state-owned computers. The settlement provides that Kentucky will no longer target websites for restriction just because they are blogs, and will instead treat them in the same way it treats other websites with similar content. In other words, classifying a website as a “blog” is no longer a good enough reason to ban a site on the state’s computers.

AP: Drudge Retort matter ‘closed’, Lost Remote
The Associated Press has issued a vague statement surrounding its bizarre attempt to remove short excerpts of its content from the Drudge Retort. It says the AP provided additional content to the Drudge Retort “aimed at enabling Mr. Cadenhead to bring the contributed content on his site into conformance with the policy he earlier set for his contributors. Both parties consider the matter closed.” The statement goes on to say that the AP spoke with some bloggers about it, and the “resolution of the matter illustrates that the interests of bloggers can be served while still respecting the intellectual property rights of news providers.” Meanwhile, everyone continues to beat up on the AP — TechCrunch is even issuing the AP a takedown order for a TechCrunch quote that appeared on the wire. And the LA Times published an opinion saying the AP “pulled a Metallica online,” which is to say, illustrated its “cluelessness about the internet.”

Our Congress Has Failed Us: Gives In On Telecom Immunity, Techdirt
We mentioned the rumored "compromise" bill concerning telecom immunity earlier this week, and now it appears that leaders of both the House and the Senate have agreed to wording in the bill which will be brought to the floor today. From the sound of it, it's exactly what we feared: Congress has effectively given in to the administration, allowing it to grant immunity to any telco. Apparently, all that talk about not allowing the worst of this bill to go through was just talk. It's difficult to know where to begin in reviewing this "deal." It's hardly a compromise -- it's a get out of jail free card.

CDT Urges Congress to Reject FISA Amendment Legislation, CDT
CDT today urged Congress to reject legislation to amend the Foreign Intelligence Surveillance Act that is expected to be voted on in the House tomorrow and in the Senate next week. The legislation fails to give the FISA court adequate authority to ensure that the Americans are protected against unjustified surveillance of their communications. It also provides immunity to telecommunications carriers that assisted with warrantless surveillance for years after the 9/11 terrorist attacks.

Court Rules That Your Text Messages Are Private, Techdirt
A few months ago, we noted that New York City was demanding text messages sent by some people as part of an investigation. This was just the latest in a long line of requests for text messages, where questions have been raised about whether or not those messages should be considered private. Now, a court in the 9th circuit has said that there's a reasonable expectation of privacy on text messages, and a company revealing them without consent from either the sender or the recipient represents a violation of the Fourth Amendment.
