The group's long list of strange bedfellows includes the ACLU, Google, Consumer's Union, Internet2, OpenDNS, Free Press, the Writers Guild of America, the Nancy Drew fan fiction club and many more -- though I think they fail to directly tackle this industry's most pressing problem. This morning I attended an excellent Freedom Forum conference on “Indecency & Violence in the Media: FCC v. Pacifica 30 Years Later.” At the event, Lili Levi of the University of Miami School of Law delivered a terrific address entitled “A Short History of the Indecency & Media Violence Wars.” (Incidentally, she is also the author of a highly recommended paper on the topic that is available on SSRN: “The FCC’s Regulation of Indecency.”

As I've covered, Comcast will be changing the way they deal with users who consume "excessive" amounts of bandwidth on their network. Instead of using Sandvine gear to forge packets in order to disrupt upstream P2P traffic for all users, 24/7, the company will be using a new multi-pronged approach. Internally, the currently favored plan involves a clear 250GB cap, overage fees and increased DMCA enforcement.

According to traffic shaping vendor Sandvine, some 44% of all bandwidth consumed on networks operated by North American Internet service providers is thanks to P2P. Sandvine compiled data from several "leading" ISPs, and found that the largest consumers of bandwidth were file sharing (43.5%); Web browsing (27.3%); and streaming media (14.8%). Other usage included VPNs (5.9%); newsgroups (5.6%); online games (1.4%); and voice over IP (0.2%). Exploring upstream consumption only: P2P (75.0%); tunneling (9.9%); and Web browsing (9.1%).

The Internet Corporation for Assigned Names and Numbers (ICANN) has just approved the relaxation of the rules for the introduction of new Top-Level Domains -- a move that could drastically change the Internet. The new decision -- some calling it of historic importance and others predictable -- will allow companies to register their brands as generic top-level domain names (TLDs). For instance, Microsoft could apply to have a TLD such as '.msn' and Apple apply for '.mac'.

While the initial reports on the so-called "compromise" bill on FISA suggested that it would breeze through Congress, it appears that public outrage over this issue may have some Senators thinking twice.
