“Infrastructures, for purposes such as transportation
and communication, have long been vital to national
welfare. They knit together a country's economy by
facilitating the movement of people, products,
services, and ideas, and play important roles in
national security.” NSFNET Final Report (1995), p. 4.

More Thoughts of Philly: Three Months After the
Philadelphia Story., Sascha Meinrath
In December 2007, the New America Foundation released
an in-depth report and analysis of the Philadelphia
Wireless project. This New America Foundation report
focused on productive interventions and potential
opportunities for community organizers and
decision-makers, but was met with hostility by
Wireless Philadelphia and Civitium.

Snooping as Free Speech: Verizon Claims Revealing
Sensitive Customer Data is Its Right, Peerflow

Christians, Rockers and Pro-Choicers Testify for Net
Neutrality, Ecommerce Times
The House Judiciary Committee held a panel hearing on
the issue of net neutrality Tuesday, hearing testimony
from such diverse interests as a rock band, an
abortion rights advocacy group and the Christian
Coalition of America. The unlikely trio converged on
the Hill to call for legislation that would ensure
that cable and telco Internet service providers do not
dole out broadband -- or restrict its use -- for
political reasons. Chairman John Conyers, D-Mich.,
said legislation was needed to codify net neutrality
into law.

Time Warner Cable Will Be Spun Off - As company shrugs
off FiOS competition
, dslreports
Time Warner Cable executives this week confirmed
speculation that Time Warner will likely spin off Time
Warner Cable, and the move will probably come by
mid-April. Time Warner is trying to shore up their
sagging stock price, so they're making a lot of noise
this week (which includes ditching the perpetually
dysfunctional AOL unit) in an effort to excite
investors. Meanwhile, Time Warner Cable CFO Rob Marcus
insists that FiOS is not taking broadband market share
away from the cable company:

Air Force The Latest To Make Illegal False DMCA Claim,
Techdirt
We've seen way too many bad DMCA takedown notices over
the years, but this latest one may be the most
ridiculous yet. A lawyer representing the Air Force
has issued a takedown notice on an advertisement that
the Air Force released publicly about its cyberdefense
initiatives. There are so many things wrong with this,
it's difficult to know where to start. First off, the
Air Force was using this as an advertisement that they
wanted displayed as widely as possible. In fact, the
Air Force specifically sent the ad to sites like

IFPI's New Strategy: Sue ISPs For Not Stopping File
Sharing, Techdirt
Earlier this year, the IFPI was successful in
convincing a court to force a Danish ISP to block
access to the Pirate Bay. Rather than recognizing that
this only helped drive more traffic to the Pirate Bay,
the folks at the IFPI seem to have gotten it into
their heads that the best course of action is to start
suing ISPs for not stopping file sharing. Its first
target is the large Irish ISP Eircom. Eircom points
out all the obvious things: it has no idea what its
users are doing on the network, it's just providing
the network -- and no one had made it aware of any
specific infringing activity. Rather than deal with
those

Martin Side Stepped Forced FCC Exit - As the cable
industry faces potential lose-lose FCC situation,
dslreports
FCC boss Kevin Martin has recently been accused of
making the cable industry his personal whipping boy.
Some of that is legitimate criticism, given he
frequently hammers the cable industry for things the
phone companies are also doing (note his attack on
cable astroturfing while ignoring similar tactics by
the phone industry). But some decisions are (his a la
carte, indecency pushes in particular) Martin's
attempt to appeal to "family values" groups with one
eye on a post-FCC North Carolina political career.

A Free Speech Double Whammy: Flawed Anti-Phishing Bill
Would Dilute Trademark Fair Use and Anonymity
Protections, EFF
Congress is contemplating a so-called “Anti-Phishing
Consumer Protection Act” (APCPA) that takes an odd
view of consumer protection. In the name of stopping
phishing schemes, Senator Olympia Snowe has introduced
S. 2661, a bill that would expand trademark law, limit
consumer access to information about competitive
products, and eviscerate key protections for anonymous
speech. Co-sponsors are Senators Bill Nelson and Ted
Stevens (yes, THAT Ted Stevens)

Defend Your Right to Free Speech: Tell the FCC to
Protect Text Messaging!, pk
Next up in our campaign for open phones and an open
Internet is the Public Knowledge-Free Press petition
that seeks to ensure that wireless phone companies do
not block your text messages. Here are the facts:
Verizon wireless blocked its customers from receiving
NARAL Pro-Choice America action alert text messages –
messages that Verizon customers had asked to receive -
because it deemed those messages to be too
controversial. While Verizon reversed its decision in
the NARAL case, the company still maintains that it
can decide who their customers can communicate with.
And although Verizon promised Congress that it would
develop a new text message policy some five months
ago, we have yet to see it.
